Trading conditions for purchases in the Packyard.dk webshop.
These terms and conditions ("the terms"), which are issued by KB Supply ApS ("seller"), apply to any distance sale of the seller's products ("products" or "the products" or "product") carried out on Packyard.dk (" the webshop"), and where the buyer is a consumer who is a natural person and who does not act commercially ("the customer").
For traders, the seller's general terms and conditions of sale and delivery apply.
To be able to buy products in the webshop, the customer must be 18 years old and in possession of a valid payment card issued in Denmark. When the customer buys goods in the Webshop, the customer simultaneously accepts the conditions, and the customer is therefore obliged to review the conditions thoroughly before the customer orders products in the Webshop. The customer can read or print the conditions on the webshop and in the order confirmation.
All agreements between the customer and the seller are concluded in Danish, and the agreements are saved by the seller. The customer can access the agreements by creating a customer account directly on the Webshop.
Seller reserves the right to revise and change the conditions from time to time. The customer's order will be subject to the conditions that apply at the time the customer orders products from the seller, see point 4. If the conditions change after the customer's order, but before the order confirmation is sent by the seller, the customer will be informed of this.

2. Products
The customer can find information about the seller's products on the webshop, where a description of the seller's products is also available. The range of products on the webshop is only an invitation to the customer to make an offer by sending an order to the seller. The agreement is only final when the seller has accepted the customer's offer by sending an order confirmation to the customer, see points 4 and 5.
Please note that it may happen that the image of a product on the Webshop does not correspond to the product's actual appearance.
3. Price
The price for the seller's products in the webshop is stated in DDK and includes VAT. The seller is only bound by the prices stated on the webshop until the time when the seller sends the order confirmation. Until then, the seller reserves the right to reject the customer's order. Please note that delivery costs are added to the price of the products, see points 4, 5 and 6.
4. Order and confirmation of order
To buy a product, the customer must find the product the customer wants and click "Add to basket". If the customer wants an overview of what the customer wants to buy, the customer must select "Basket". When the customer wants to complete the purchase, the customer chooses either "Login & Order" or "Browse & Order", after which the customer selects delivery and contact information and finishes by choosing "Browse & Order". The customer then receives an overview of the order (the "Order") and the total price incl. VAT and delivery costs. If the customer wishes to change the order, the customer must select "Edit Order". If the customer can approve the order, the customer must accept the conditions by selecting "I accept the trading conditions" and then selecting "Proceed to Payment". The payment method is selected and the payment information is filled in, and "Make Payment" must be selected.
In connection with placing the order, the customer receives an order confirmation by e-mail. The seller hereby confirms having received the customer's offer and that the seller will investigate whether the order can be fulfilled.
5. Order confirmation and invoice
The customer receives an order confirmation per e-mail, as acceptance from the seller, which should be saved. The order confirmation contains an overview of the customer's order as well as the customer's name, address, goods, price, terms of payment, place of delivery as well as delivery costs and the conditions that the customer has accepted. If the customer wishes to view or print an order confirmation, the customer can log into the customer's customer account directly on the Webshop, where you can view and print the order confirmation and invoice.
When the order has been sent to the customer, the customer receives information about this together with the final invoice per e-mail, where the delivery costs are also stated.
6. Payment
The customer can pay with the following cards issued in Denmark:
- Dankort
- Visa Dankort
- MasterCard
- JCB
- American Express

- Visa Electron
The customer must enter the card number, expiry date and control digits when ordering products. It is free of charge to pay by card in the Webshop. The amount will be withdrawn from the customer's account when the Seller ships the Product(s) to the customer. The webshop uses ePay as a payment solution and payment by debit and credit card via the webshop is secure and certified by the card issuer. All payments are made via an encrypted internet connection.
7. Place of delivery and time of delivery
The seller ships the order in Denmark 1–2 working days after sending the order confirmation, except for goods where it is stated that it is a made-to-order item with a longer delivery time.
The item is delivered to the customer's chosen delivery location within 1-3 business days.
When the customer receives the order, the customer is encouraged to check that the product/number of delivered products corresponds to the customer's order and that the product(s) and its/their packaging are not damaged or altered in any way. The seller reserves the right to delivery time in the event of force majeure.
The seller shall therefore not be liable in the event of circumstances which appear in the following non-exhaustive list and which prevent or delay the seller's compliance with the agreement:
Disruptions in operations as a result of legislation.
Actions taken by state or public authorities.
Acts of war Terrorism
Strikes
Physical blockades
Lockouts
Fire and natural disasters
In these cases, both parties are entitled to postpone their contractual obligation until the problem has ceased, or alternatively, the parties are entitled to cancel the agreement in whole or in part without the parties incurring any liability for this in the event that the problems result in the fulfillment of the contractual obligations is delayed by more than six (6) months.

8. Right of withdrawal
The customer (consumer) has a 14-day right of withdrawal, which runs from the time when the customer or the third party specified by the customer, but not the carrier, receives the product(s), or takes physical possession of the last product, in the case of an agreement on several different items that are ordered in one order and that are delivered individually. The customer is liable for any deterioration in the value of the product(s) which is due to handling of the product(s) other than what is necessary to determine the product(s) nature, properties and the way they function. This is, among other things, the case if the product(s) have been used, worn, altered or washed, or if the original tags/marks have been removed or have been removed and reattached. Missing original packaging may constitute a reduction in value, so to be sure of receiving all the money back, it is recommended that the item is returned in original packaging.
In order to cancel the purchase, the customer must make an express declaration to this effect to the seller within 14 days of receipt. The customer can print a cancellation form directly from the Webshop, which can be filled out and sent to the seller at the e-mail address: info@packyard.dk
You cannot undo it simply by refusing to receive the goods without at the same time clearly notifying us of this.
You bear the risk for the goods from the time of delivery of the goods.
Cancellation of part of the purchase
If you have purchased several items from us, you have the option of returning one or more items, even if they were purchased under one order. Please note that you will not get the delivery costs back if you regret part of your purchase.
Return
When using the right of cancellation, the customer is obliged to send or hand over the delivered product/products to the seller without undue delay and no later than 14 days after the date on which the customer has notified the seller of his decision to use the right of cancellation. The seller is obliged to refund the full price for the product(s) returned by the customer, including delivery costs (but not extra costs as a result of your own choice of a different form of delivery than the cheapest form of standard delivery that we offer), under provided that the value of the product(s) has not been impaired as a result of handling the product(s) other than what is necessary to determine the nature of the product(s), properties and the way they (t) function. the seller reserves the right to set off such a decrease in value, determined at the seller's discretion, upon repayment of the purchase price.
The customer bears the costs of returning the product(s), and the costs incurred are not reimbursed by the seller. It is possible to order a cheap return label through our return portal. Read more here: https://retur.pakkelabels.dk/packyard
The seller's repayment is made using the same payment method that was used when paying the purchase price. The buyer is not entitled to interest on repayment of the amount. Repayment must take place as soon as possible and no later than 14 days after the customer has informed the seller that the customer wishes to make use of his right of withdrawal. However, the seller is entitled to withhold the refund until the seller has received the product/products back from the customer, or until the customer has provided documentation that the product/products have been returned, whichever is the earliest.
The seller sends an e-mail to the customer when the refund has been completed.

9. Complaints
The rules in the Sales Act (Legislative Order no. 140 of 12 February 2014) on defects in products apply to the purchase of products from a seller that is covered by the scope of the Sales Act. The customer has a 24-month right of complaint if the product is defective or defective upon delivery. It is a requirement that the complaint is justified and that the defect has not arisen as a result of incorrect use of the product or other damage-causing behaviour. The customer can download, read, save or print a complaint form on the webshop, to be used to complain about the product. The complaint form can be completed and sent by e-mail to: info@packyard.dk
Complaints must be made within a reasonable time after the customer has discovered the defect in the product. If a complaint is made within two months of the defect being discovered, the complaint will always be timely. The seller assesses whether the customer's complaint is justified and, if so, whether the customer is entitled to have the product repaired, exchanged, a reduction in the price or the money returned. When the complaint has been processed, the seller sends an e-mail to the customer with the seller's assessment of whether the complaint is justified or not.
If the complaint is justified, the seller bears reasonable shipping costs in connection with the customer's return of the product. The item must always be sent back in proper packaging, and remember to get a receipt for dispatch so that we can deduct your shipping costs.

10. Choice of law and venue
The agreement must be subject to and interpreted in accordance with Danish law without regard to Danish rules regarding private international law to the extent that application of such rules would lead to a different choice of law than Danish law. Any dispute that may arise in connection with the Agreement and which cannot be resolved amicably between the Parties must be brought before the court at the consumer's place of jurisdiction. The customer also has the right to bring the dispute before the court in the jurisdiction where the customer resides.

When you communicate with us via Packyard.dk, we - as both data processor and data controller - collect and process information about you. We take the protection of your personal data very seriously, and we therefore want to give you clarity on how we process your personal data.

In the following, you can read about what personal data we collect, what we use the information for and how long we keep it, as well as whether we share the information with others.
What personal data do we collect?
We collect, among other things, your name, e-mail address, address and other information that you may give us in connection with ordering on our website, when you sign up for our newsletters, or when you write to us via Packyard.dk. In addition, we collect information through the use of cookies.
What do we use your personal data for?
We use your personal data to process your order and send your goods, process complaints, send you newsletters and contact you when you have requested it. In addition, we also use your personal data to answer your possible inquiries and to improve the content on the Website. Personal information is registered with KB Supply ApS and stored for five years, after which the information is deleted.
What security measures do we use?

Our security procedures are continuously revised based on the latest technological developments. However, we cannot guarantee that they are completely protected against anyone who wants and succeeds in bypassing security measures and gaining access to the transfer of information that occurs via the Internet, e.g. via e-mail.
What rights do you have under the Personal Data Act?
You have the right to obtain information about the processing of your personal data, and you also have the right to request us to correct, block or delete personal data that is incorrect. You also have the right to request that your personal data is not used or transferred to third parties for commercial or statistical purposes. Security of payment
Packyard.dk takes our customers' security seriously and uses PCI certified providers to handle credit and debit card payments on Packyard.dk. To handle payments on Packyard.dk, ePay's payment gateway is used, which is certified according to the PCI standard. ePay's systems are monitored around the clock and all communication about money and card data is encrypted.
Freight & Shipping.
We offer free shipping on all orders. All goods are sent with GLS and delivered to the selected parcel shop, which takes place during your purchase flow. Or directly to the door.
Access to complaints
If you want to complain about your purchase, you must contact Packyard. If we do not succeed in finding a solution, you can lodge a complaint with relevant boards in the area, if the conditions for this are met.
