The terms & conditions when purchasing items in Packyard.com Webshop
These terms and conditions (“Terms”) are issued by Playground Distribution ApS (“Seller”) shall apply to any distance selling of the seller’s product (“Products” or “Product”), carried on Packyard.com (“Webshop”), and where the buyer is a consumer who is a physical person and not trading commercially (“Customer”).
Seller’s general terms and conditions apply to traders.
The customer must be 18 years old and have a valid payment card to purchase products in the Webshop. When the customer buys products in the Webshop, they simultaneously accept the conditions and the customer is therefore required to undergo conditions carefully before they order products in the Webshop. The customer can read or print the terms on the Webshop.
All agreements between the customer and the seller are in English, and the seller saves the agreements. The customer can only access agreements by creating a customer account directly on the Webshop.
Seller reserves the right to revise and change the conditions from time to time. The customer’s order will be subject to the conditions applicable at the time the customer orders the product from seller, see section 4. If the conditions changes after the customer’s order, but before the order confirmation sent by the seller, the seller would inform the customer accordingly.

The customer can find information about the seller’s products on the Webshop, where a description of the seller’s products are also available. The range of products on the Webshop is only an urge to the customer to make an offer by sending an order to the seller. The agreement is not final, until the seller has accepted the customer’s offer by sending an order confirmation to the customer, see section 4 and 5.
Please note that it is possible that the depiction of a product in the Webshop is not in conformity with the actual product appearance. Reservations are made for the possibility that a product may be sold out or that there may be stock shortages.
The price of the seller’s product in the Webshop are listed in EUR and including VAT. Reservations are made for any errors in the Webshop’s specified prices. Seller is not bound by the prices listed on the Webshop until the seller sends the order confirmation. Until then the seller reserves the right to refuse the customer’s order. Please note that the shipping charges will be added to the price of the product, see section 4, 5 and 6.
4. Confirmation of order
In connection with placing the order, the customer receives an order confirmation by email. Seller herby confirms receiving the customers offer, and the seller will examine whether or not the order can be accommodated.
5. Order confirmation and invoice
The customer receives an order confirmation on e-mail, as acceptance from seller, which the costumer should save. The order confirmation contains a summary of the customer’s order and the customer’s name, address, items, prices, payment terms, delivery location, delivery costs and conditions accepted by the customer. If the customer wants to view or print the order confirmation, the customer can log in to the customer’s account directly on the Webshop where you can view and print the order confirmation and invoice.
When seller ships the order to the customer, the customer receives a briefing on the issue together with the final invoice on e-mail, which also includes shipping costs.
The customer can pay with the following cards:

- American Express
The customer must enter the card number, expiration date and security code when ordering products. There is no fee when paying by card on the Webshop. There may however be imposed a fee by the customer’s card issuer, that the store does not have any control over. The full amount is withdrawn from the customer’s account, when seller ships the product(s) to the customer. If there are insufficient funds on the card, seller reserves the right to cancel the order, and contacts the customer. The Webshop uses ePay as a payment solution and payment with debit- and credit cards on the Webshop is safe and certified by the card issuer. All payments occurs on an encrypted internet connection.
7. Delivery place and shipping time
Seller sends the order from Denmark 1-2 days after sending the order confirmation, with the exceptions of items indicated as on order with longer delivery times.
When the customer receives the order, the customer is obligated to examine that the product/the number of delivered products corresponds to the customer’s order, and that the product(s) and its/their packaging is not damaged or altered in any way. Seller makes reservation for shipping time in case of force majeure.
Seller shall therefore not be liable in case of conditions, given in the following non-exhaustive list, which prevents or delays the seller’s compliance with the agreement:
Disruptions in operations because of legislation.
Actions made by head of states or governments.
Acts of war/Terrorism
Fire and natural disasters
Both parties are in these cases entitled to have exposed their contractual obligations, until the problem is resolved or, in the alternative, the parties are entitled to cancel the contract in whole or in part without the partners thereby incur a responsibility to this in case of the problems mean that fulfillment of the contractual obligations become more than 6 (six) months delayed. If the sellers delivery is delayed by more than 14 days, the customer is entitled to cancel the order, and any amounts already paid by the customer, must be refunded to the customer as soon as possible and no later than 30 days after seller receives the customer’s cancellation of his order.
All items are shipped with GLS or Post Danmark parcel.

The customer has 14-days right of withdrawal, from the day where the customer, or the customer of a third party other than the carrier, receives the product(s). The customer is liable for any deterioration of the product(s) value, as a result from handling the product(s) in other ways than it’s necessary to determine the products nature, specifications and the way it operates. This is also the case, if the product(s) have been used, worn, changed or washed, or if the original tags/labels have been removed, or removed and then reattached. The original packaging is considered as a part of the product(s) if the customer has to exercise its right of withdrawal.
To cancel the purchase, the customer must make an explicit declaration to the seller. The customer can print out a withdrawal form directly from the Webshop, which can be filled out and sent to the seller on the email address: firstname.lastname@example.org
In the event of withdrawal, the customer is required to send or deliver the supplied product(s) to the seller without undue delay and within 14 days from the date on which the customer has informed the seller of his decision to exercise the right of withdrawal. The seller is obliged to refund the full price for the product(s) the customer returned, provided that the product(s) value has not been impaired, as a result of handling the product(s) in other ways than it’s necessary to determine the products nature, specifications and the way it operates. The seller reserves the right to offset such loss of value, set by the seller’s discretion, by the refund of the purchase price.
The customer bears the cost of returning the product(s), and the seller is not required to refund the cost. The seller’s refund is done using the same payment method that was used during the purchase of the product. The seller is not entitled to interest on the refund of the amount. Refunds must be made as soon as possible and no later than 14 days after the customer have informed the seller that the customer wants to use his right of withdrawal. The seller is however entitled to withhold the refund, until the seller has received the product(s) from the customer, or until the customer has presented documentation/evidence that the product(s) have returned, whichever is the earliest.
The seller sends an e-mail to the customer once the refund is completed.
The rules of Sales of Goods Act (Act no. 140 of February 12, 2014) about defects in products is applicable to the purchase of products from seller, which is covered by the Sales of Goods Act’s scope. The customer has 24 months warranty, if the product is defective or faulty on delivery. The customer can download, read, save or print out a complaint form on the Webshop to complain about the product. The claim form can be filled out and sent by e-mail to:
There must be complained within reasonable time after the customer has discovered the defect in the product. If the complaint is within two months after the defect is discovered, the claim is always timely. Seller deals with the complaint within 30 days after having received the product return. Seller assess whether or not the customer complaint is justified, and if so, the customer is entitled to have the product repaired, replaced, price reduction or a refund. When the complaint is finalized, the seller sends an e-mail to the customer with seller’s assessment of whether the claim is justified or not.
If the complaint is justified, the seller is accountable reasonable shipping costs in connection with the customer’s return of the product(s).
10. Governing law and jurisdiction
The agreement shall be governed and interpreted in accordance with Danish law without regard to Danish rules regarding international private law in the extent where the application of such roles would lead to a different choice of law than Danish law. Any dispute arising in connection with the Agreement, and which cannot be resolved amicably between the parties shall be brought before the court at Seller’s domicile. The customer also has the right to refer the dispute to the court in the jurisdiction, where the customer resides.
When you communicate with us through Packyard.com, we collect and process – as both processors and data controller – information about you. We take the protection of your personal data very seriously, and we therefore want to give you clarity on how we treat your personal data.

What personal information do we collect?
We collect your name, e-mail address, address and other information, that you may give us when ordering on our website, when you sign up for our newsletter, or when you write to us through Packyard.com. In addition, we collect information about cookies.
What do we use your personal information for?
We use your personal information to process your order and ship your items, process claims, send you newsletter and contact you, when you request it. In addition, we also use your personal information to answer your possible inquiries and to improve the content of the website. The information may also be used to make statistics of the users on the website.
Do we disclose personal information to others?
The personal information you provide through the website will in some cases be disclosed to others. The disclosure will happen in cases where it is necessary to perform the service you asked for, i.e. the delivery of your order or similar services that require us to use your information. Your person information may disclosed to: (i) suppliers we work with to support our business (eg. Suppliers of services, technical support, shipping services and financial institutions); or (ii) in in connection with the sale, assignments or other transfers of the contents on the website; or (iii) if required by law, a court order or current law.

Safety of payment
Packyard.com take our customer’s security seriously and uses PCI certified providers to handle the credit- and debit card payments on Packyard.com To handle payments on Packyard.com, we use ePays payment gateway which is certified by the PCI standard. ePay systems are monitored around the clock and all communications regarding money and card data is encrypted.
Shipping costs €20.- All products are shipped with GLS or Post Denmark and delivered to the selected package shop / address, which is chosen during your shopping flow.
